PLEASE NOTE THAT OUR PRODUCTS ARE PROFESSIONAL SPA PRODUCTS. WE RECOMMAND YOU CONSULT WITH YOUR PROFESSIONAL ESTHETICIANS PRIOR TO PURCHASE. IT IS IMPORTANT TO KNOW YOUR SKIN TYPE AND PROTOCOL RECOMMENDED FOR YOU SPECIFICALLY.

PROFESSIONAL PRODUCTS are for spa use AND OR FOR Retail customer purchasing for home/ personal use. Selling of professional products, testers, gifts with purchase and samples is forbidden.

RELATIONSHIP BETWEEN -FUTURE 5 ELEMENTS AND THE RETAILER The agreed relationship between the two parties is solely based on end-user retailing and not distribution of products.

PRICE CHANGES -FUTURE 5 ELEMENTS will attempt to provide reasonable notice to Retailer of any price changes. However, all prices are subject to change without notice. The consumer price index has increased dramatically in 2022, due to inflation.

FUTURE 5 ELEMENTS may decline any or all parts of any order. Previous shipments do not obligate FUTURE 5 ELEMENTS to continue servicing or selling to any Whole seller/ Retailer- End consumer.

PRODUCT CHANGES -FUTURE 5 ELEMENTS reserves the right at any time to discontinue the production, sale, or distribution of any of the Future Cosmetics 5 Elements, to change the design(rebrand) of its products and any parts thereof, and to change its service, warranty, or other policies without advance notice or obligation of any kind whatsoever.

RETURNS- No returns of merchandise will be accepted without prior written approval from FUTURE 5 ELEMENTS. Returns will be approved for damaged or Incorrect goods only.  AND MUST BE WITHIN 7 BUSINESS DAYS OR PARCEL ARRIVAL; We do not replace open Product; unless damaged and in that case must be send back to Future 5 Elements to receive replacement.

If your merchandise is damaged or incorrect upon arrival, save all contents and packing materials, document damages with pictures and contact us within 7 days. Shipments that arrive in damaged condition will be replaced only after the damaged merchandise has been returned.

Written approval from FUTURE 5 ELEMENTS IS REQUIRED.

TAXES AND EXPENSES if applicable; customer shall pay all shipping fees (unless minimum order of $75.00 and up is met - free shipping will apply) , duties, taxes, or other charges associated with its purchase, sale of Future 5 Elements.

MARKETING MATERIALS – Future 5 Elements owns all marketing materials.

INTERNET The sale of Future 5 Elements products on the internet is prohibited – unless wholesale account was approved.

SHIPPING- FUTURE 5 ELEMENTS only ships products Monday through Friday (except on USA statutory or federal holidays). Please give 1-3 business days for order processing and 1-5 shipping days. Typically, deliveries in the US are 1-3 business days arrival time yet on holidays or busy seasons- shipping estimate can be 5-10 days arrival time.

In 2022 there are many unforeseen delays and additional charges with shipping - Future 5 Elements makes all efforts to ship in a timely manner of 1-3 business days and once the parcel leaves our facility it is out of our control; our customer to have the option to rush the shipping for additional fees yet still there are not 100% obligation responsibility from the shipping companies.

In addition, we do require customer to sign for delivered parcels, if Customer waives requirement in writing only, Future 5 Elements is not responsible for lost or stolen parcel/s. receiver is responsible for their shipment release.

Once parcel is packed, we update the system with your tracking number which you can see on the order you placed. Please make sure you submit an email address and/or Mobile Number to get confirmations/ tracking.

FUTURE 5 ELEMENTS is not liable for any factors outside of its control that cause delays or interruption of deliveries, including but not limited to strikes, weather conditions, pandemics, epidemics, accidents, or other conditions, which may delay or prevent the preparation or delivery of orders.

LIMITATION OF LIABILITY In no event shall FUTURE 5 ELEMENTS be liable for any consequential, indirect, incidental, special, exemplary, or punitive damages, lost profits or revenues or diminution in value, arising out of or relating to any breach of these working terms, whether or not the possibility of such damages has been disclosed in advance by retailer or could have been reasonably foreseen by FUTURE 5 ELEMENTS, and whether arising out of or related to breach of contract, law or otherwise. Moreover, in no event shall FUTURE 5 ELEMENTS aggregate liability arising out of or related to these working terms, whether arising out of or related to breach of contract, law or otherwise, exceed the total aggregate amount paid to FUTURE 5 ELEMENTS for the products sold hereunder during the twelve (12) month period preceding the latest event giving rise to FUTURE 5 ELEMENTS liability.

GOVERNING LAW All matters arising out of or relating to these Working Terms are governed by and construed in accordance with the laws of the State of CALIFORNIA and the federal laws of the United States of America applicable therein without giving effect to any choice or conflict of law provision or rule (whether of the State of CALIFORNIA or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of CALIFORNIA. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Working Terms.

CHOICE OF FORUM Any legal suit, action, litigation or proceeding of any kind whatsoever in any way arising out of, from or relating to these Working Terms and all contemplated transactions shall be instituted in the courts of California and shall be irrevocably submitted to the exclusive jurisdiction of such courts in any such suit, action, litigation or proceeding.

 A final judgment in any such suit, action, litigation, or proceeding is conclusive and may be enforced in other jurisdictions by suit on the judgment or in any other manner provided by law.

NON-ASSIGN ABILITY Retailer may not assign or transfer any of the rights granted hereunder, without the prior written consent of FUTURE 5 ELEMENTS.

 RELATIONSHIP OF THE PARTIES The rights granted hereunder do not deem Retailer to be an agent, partner, joint venture, or legal representative of FUTURE 5 ELEMENTS for any purpose. Retailer shall not represent itself as an employee, partner, representative or agent of FUTURE 5 ELEMENTS. Retailer is not granted any right or authority to assume or to create any obligation or responsibility express or implied, in behalf of or in the name of FUTURE 5 ELEMENTS or to bind FUTURE 5 ELEMENTS in any manner.

PAYMENT Terms of payment- All orders are to be paid in full prior to shipping of the products.
